Welcome to TEMPO. These Terms of Service ("Terms") govern your use of the TEMPO mobile application and website at tempojournal.app (collectively, the "Service"). By accessing or using TEMPO, you agree to be bound by these Terms.
You must be at least 13 years old to use TEMPO (16 years old if you are in the EU/EEA). By using the Service, you represent that you meet this age requirement. If you are under 18, you represent that your parent or guardian has reviewed and agreed to these Terms.
You are responsible for maintaining the security of your account credentials. You agree to notify us immediately if you suspect unauthorized access. You are responsible for all activity that occurs under your account.

You retain full ownership of your voice recordings, transcripts, and any content you create using TEMPO. By using the Service, you grant TEMPO a limited, non-exclusive license to process your content solely for the purpose of providing the Service (transcription, mood analysis, and storage). We do not use your content for advertising or any purpose other than delivering the Service to you. Our AI provider (OpenAI) processes your audio via their API, which per their API data usage policy does not use API inputs to train their models.

If you are a consumer in the European Union, you have a 14-day right of withdrawal on digital subscriptions. You may exercise this right by contacting us within 14 days of purchase. If you have actively used the Service during this period with your prior consent, you acknowledge that you may lose this right of withdrawal.

TEMPO is a personal journaling and self-reflection tool. The AI mood detection feature provides general categorizations of emotional tone for personal insight only. It is not a clinical assessment, diagnosis, or treatment of any medical or mental health condition.
TEMPO does not provide medical advice, mental health counseling, therapy, psychiatric treatment, or crisis intervention. The mood categories generated by TEMPO should not be relied upon for any health-related decisions.

TEMPO, including its design, code, branding, and features, is owned by TEMPO and protected by applicable intellectual property laws. You may not copy, modify, distribute, or create derivative works of any part of the Service without our written consent.
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. We do not warrant that the Service will be uninterrupted, error-free, or completely secure.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, TEMPO AND ITS OPERATORS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF DATA, PROFITS, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE, REGARDLESS OF THE THEORY OF LIABILITY.
Our total liability to you for any claims arising from or related to the Service shall not exceed the amount you paid us in the 12 months preceding the claim.
You agree to indemnify and hold harmless TEMPO and its operators from any claims, damages, losses, or expenses (including reasonable legal fees) arising from your use of the Service, your violation of these Terms, or your violation of any third-party rights.
Any disputes arising from or relating to these Terms or the Service shall first be attempted to be resolved through informal negotiation by contacting us at hello@tempojournal.app. If informal resolution fails, disputes shall be resolved through binding arbitration administered in accordance with applicable rules, except that either party may seek injunctive relief in court. You agree to waive any right to participate in a class action lawsuit or class-wide arbitration.
These Terms shall be governed by and construed in accordance with the laws of the Republic of Slovenia, without regard to conflict of law principles. For EU consumers, mandatory consumer protection laws of your country of residence shall apply.
We may suspend or terminate your access to TEMPO at any time for violation of these Terms. You may stop using the Service at any time. Upon termination, your right to use the Service ceases immediately, but provisions that should survive (such as intellectual property, limitation of liability, and indemnification) will remain in effect.
We may update these Terms from time to time. We will notify you of material changes by posting the updated Terms with a new "Last updated" date. Your continued use of TEMPO after changes constitutes acceptance of the updated Terms.
